Terms and Conditions
These Terms of Service (“Terms”) govern your access to and use of the Givvie website, mobile application, and related services (the “Service”), operated by Givvie, Inc. (“Givvie,” “we,” “us,” or “our”).
By accessing or using the Service, you agree to be legally bound by these Terms. If you do not agree, you may not use the Service.
1. Our Role as a Platform
Givvie is a technology platform that facilitates the purchase and gifting of digital vouchers redeemable at participating partner venues.
Givvie:
Is not the merchant providing food, beverages, or other goods/services
Does not control or guarantee the quality, safety, legality, or availability of any venue’s offerings
Is not responsible for the acts or omissions of partner venues
Any contract for goods or services redeemed through a gift is solely between you and the partner venue.
If you experience an issue with a redemption, product, or service, you must contact the relevant venue directly.
2. Eligibility
You must be at least 18 years old (or the legal age of majority in your jurisdiction) to use the Service.
By using Givvie, you represent and warrant that:
You meet this age requirement
You have the legal capacity to enter into binding agreements
All information you provide is accurate and complete
3. Account Registration and Security
To access certain features, you must create an account.
You agree to:
Provide accurate and current information
Maintain the confidentiality of your login credentials
Notify us immediately of unauthorized use
You are responsible for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
4. Gifting and Redemption Terms
4.1 Digital Nature of Gifts
All gifts purchased through Givvie are digital vouchers delivered electronically.
4.2 Redemption
Gifts:
Are redeemable only at the selected participating venue
Must be presented in accordance with the redemption instructions (e.g., QR code validation)
Are subject to the venue’s availability and operating hours
4.3 Validity Period
Unless otherwise stated, gifts are valid for 12 months from the date of purchase. After expiration, vouchers are void unless required otherwise by applicable law.
4.4 Fixed Value
Gifts:
Have a fixed monetary value
May be applied toward eligible purchases at the venue
Are non-reloadable
Unless required by law:
Gifts have no cash value
Gifts cannot be exchanged for cash
Unused balances do not carry over after expiration
5. Pricing and Payments
All prices are displayed in the applicable currency and include VAT where required.
Payments are processed securely via Stripe. By completing a purchase, you also agree to Stripe’s applicable terms and privacy policies.
Givvie does not store full payment card details.
We reserve the right to correct pricing errors and cancel transactions in case of clear technical mistakes.
6. Refund Policy
Due to the digital and immediately deliverable nature of Givvie vouchers:
Once a gift has been delivered, purchases are generally non-refundable
Refunds may be issued at our discretion in cases of technical failure, duplicate purchase, or legal obligation
If a venue permanently ceases operations before redemption, we will make reasonable efforts to provide an alternative solution, which may include a replacement voucher or refund.
Nothing in this section limits your statutory consumer rights under applicable law.
7. Merchant Participation
Partner venues agree to honor valid vouchers in accordance with our platform guidelines.
However, Givvie:
Does not guarantee merchant participation indefinitely
Is not liable for service quality, refusal of service for lawful reasons, or venue-specific policies
8. Acceptable Use
You agree not to:
Use the Service for unlawful, fraudulent, or misleading purposes
Attempt to disrupt, hack, or interfere with the platform
Impersonate any person or entity
Reverse engineer or copy the platform
Use the Service for unauthorized commercial exploitation
Violation may result in suspension or permanent termination.
9. User Content
You may submit content such as:
Gift messages
Profile information
Reviews or feedback
You retain ownership of your content.
However, by submitting content, you grant Givvie a limited, non-exclusive, worldwide license to use, store, and display such content solely for operating and improving the Service.
You are responsible for ensuring your content:
Does not infringe third-party rights
Is not unlawful, abusive, or misleading
We reserve the right to remove inappropriate content.
10. Intellectual Property
All platform content, branding, logos, designs, software, and materials associated with Givvie are owned by Givvie, Inc. or its licensors.
You may not:
Copy
Modify
Distribute
Commercially exploit
any part of the Service without prior written permission.
11. Disclaimer of Warranties
To the maximum extent permitted by law, the Service is provided on an “AS IS” and “AS AVAILABLE” basis.
We do not guarantee:
Continuous or uninterrupted access
Error-free operation
That the Service will meet your expectations
Nothing in these Terms excludes warranties that cannot be excluded under applicable consumer law.
12. Limitation of Liability
To the fullest extent permitted by law:
Givvie and its officers, directors, employees, and affiliates shall not be liable for:
Indirect, incidental, consequential, or punitive damages
Loss of profits, goodwill, or data
Our total aggregate liability shall not exceed the total amount you paid through the Service in the preceding 12 months.
This limitation does not apply to liability that cannot be excluded under applicable law (including fraud, gross negligence, or mandatory consumer protections).
13. Indemnification
You agree to indemnify and hold harmless Givvie, its affiliates, and employees from any claims, damages, or legal expenses arising from:
Your misuse of the Service
Your violation of these Terms
Your infringement of third-party rights
14. Termination
We may suspend or terminate your access:
If you violate these Terms
If required by law
If your conduct poses risk to the platform or other users
You may stop using the Service at any time.
Termination does not affect rights or obligations accrued prior to termination.
15. Force Majeure
We are not liable for delays or failure to perform resulting from causes beyond our reasonable control, including but not limited to natural disasters, internet outages, strikes, governmental actions, or third-party service disruptions.
16. Changes to These Terms
We may update these Terms from time to time.
Material changes will be communicated via email (if provided) or via notice within the Service.
Continued use after updates constitutes acceptance of the revised Terms.
17. Governing Law and Jurisdiction
If you are located in the European Union, these Terms are governed by the laws of the Netherlands, and mandatory consumer protection laws in your country of residence may also apply.
If you are located outside the EU, these Terms shall be governed by the laws of the State of Delaware, United States, unless otherwise required by law.
Disputes shall be resolved in the competent courts of the applicable jurisdiction, subject to mandatory consumer rights.
